Zadi Studios (Tamasin Chugg, ABN 58 294 309 406) is committed to protecting the privacy of all participants, spectators, visitors and website users. This Privacy Policy explains how we collect, use, store and disclose your personal information in connection with Zadi Studios, our website, bookings, classes, workshops and other services.

Zadi Studios is a small business and may not be required to comply with the Privacy Act 1988 (Cth). However, we have chosen to handle personal information in accordance with the Australian Privacy Principles as a matter of good practice and to provide clear expectations about how we collect, use and protect personal information.

This Privacy Policy should be read together with our Terms & Conditions, which set out age requirements, parent/guardian consent and the conditions of participation.

1. WHAT INFORMATION WE COLLECT

We collect personal information that is reasonably necessary to operate our studio and provide our services, including:

• Booking information: name, email address, phone number, session date and type, and payment information. Bookings are managed through ClassBento.
• Safety information: date of birth, where required to confirm minimum age, and medical conditions or other health information you disclose for safe participation.
• Emergency contact details: name, relationship, email and phone number of an emergency contact, provided by participants and, where applicable, spectators. Used to contact someone on your behalf in the event of a medical or safety emergency.
• Participant Waiver records: signed Participant Waivers including health declarations, age confirmations and signatures. Every participant and spectator entering the studio must complete and sign the Participant Waiver before entering.
• Parent/guardian information: where a participant or spectator is under 18, the name, contact details and signature of the parent or guardian who signs the Participant Waiver on their behalf, as required by our Terms & Conditions.
•  Spectator and visitor information: name and contact details of spectators, supervisors and visitors, where collected. Used to record acknowledgement of studio risks and, where applicable, the conditions of access to the studio.
• Payment information: payment information required to process bookings and purchases. Payments may be processed through third-party payment providers. Zadi Studios does not store full credit card numbers.
• Website usage: IP address, browser and device information, pages visited, time on site, actions taken on our website, cookies and similar identifiers, and analytics information. See Section 9 for details, including our use of the Meta Pixel.
• Survey responses: product preferences, price expectations, booking intentions and, if provided, your email address. Used to understand demand and shape our product range, services and pricing.
• Marketing and communications: email address and communication preferences where you opt in to receive news from us. Mailchimp is used as our CRM and mailing list platform.
• Photographs and video: images or recordings taken during sessions where you have provided the applicable consent. Used for marketing and promotional purposes with your consent.

If you do not provide information

You are not required to provide personal information to us. However, completing and signing the Participant Waiver, including health declarations, age confirmation, emergency contact details and, for anyone under 18, parent/guardian details, is a condition of entry to the studio. If you do not provide this information, we will not be able to let you participate in or attend the class or session. Our Terms & Conditions set out how this affects your booking. If you do not provide contact details, we may be unable to process your booking or contact you about your session.

Anonymity and pseudonymity

You may make general enquiries without identifying yourself, and you do not need to give your name to complete our surveys. It is not practicable for us to deal with you anonymously or under a pseudonym for bookings or Participant Waivers. We need to identify each person in the studio to meet our work health and safety obligations, respond to medical or safety emergencies and maintain accurate waiver records.

2. HOW WE COLLECT YOUR INFORMATION

We may collect personal information:

• Directly from you when you make a booking, complete a Participant Waiver, complete a survey, contact us or subscribe to our mailing list
• From a parent or guardian who completes a Participant Waiver on behalf of a person under 18
• From your device when you visit our website, where certain information is collected automatically through cookies, analytics tools and the Meta Pixel
• From ClassBento and other service providers involved in managing your booking or payment
• Through JotForm when you complete and sign a Participant Waiver
• Through Mailchimp when you subscribe to, or interact with, our email communications and surveys
• From other third parties where this is reasonably necessary for the purposes described in this policy, or where you have consented

3. HOW WE USE YOUR INFORMATION

We use personal information only for the purposes for which it was collected or for a directly related purpose you would reasonably expect, including:

• Processing and managing your bookings
• Communicating with you about your session, confirmations, reminders and instructions
• Managing Participant Waivers
• Complying with our work health and safety and other legal obligations
• Sending marketing communications, only where you have opted in or otherwise consented where required
• Managing our customer and mailing lists through Mailchimp
• Measuring the effectiveness of our advertising and showing relevant ads to people who have visited our website, as described in Section 9
• Understanding demand and shaping our product range, services and pricing based on survey feedback
• Improving our website and services
• Responding to your enquiries and complaints
• Complying with any law, court order or regulatory requirement

You will receive communications through ClassBento in connection with your booking and through Mailchimp or other communication channels we use for customer and marketing communications.

4. WHO WE SHARE YOUR INFORMATION WITH

We do not sell, rent or trade your personal information. We may share it with:

• ClassBento: our booking platform, to manage session bookings and related communications.
• Payment providers: third-party payment processors used to process payments securely. Zadi Studios does not store full credit card numbers.
• JotForm: our form hosting, Participant Waiver collection and secure e-signature storage provider.
• Mailchimp: our CRM and email service provider, to manage customer and mailing lists and send surveys, newsletters, promotions and updates.
• GoDaddy: our website hosting and website builder provider.
• Google (Google Analytics): to understand how visitors use our website.
• Meta Platforms (Meta Pixel): to measure the effectiveness of our advertising on Facebook and Instagram and to show ads to people who have visited our website. See Section 9.
• Emergency services: in the event of a medical emergency where disclosure is necessary to protect your life or safety.
• Legal or regulatory authorities: where required or authorised by law.

All third-party service providers we use are expected to handle personal information securely and in accordance with applicable privacy laws.

Overseas disclosure

Some of our service providers store or process personal information outside Australia. Mailchimp, JotForm, GoDaddy, Google and Meta are based in the United States, and information held by them is likely to be stored or processed in the United States. These providers, and ClassBento and our payment providers, may also use servers or subcontractors in other countries. Where information is disclosed overseas, we take reasonable steps to use providers that maintain appropriate privacy and security protections.

5. SENSITIVE INFORMATION

We collect limited sensitive information, including health-related information disclosed in your Participant Waiver.

This information is collected only to help ensure your safety during sessions and to meet our work health and safety obligations.

It is stored securely, accessed only by Tamasin Chugg and instructors or other people who need it for safety purposes, and is not used for any other purpose.

We will seek your consent before collecting sensitive information beyond what is reasonably required for safety purposes.

6. DATA SECURITY

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure, including:

• Secure password-protected systems for digital records, including Participant Waivers stored through JotForm
• Physical security for any signed paper waivers or records
• Secure third-party payment processing
• Limiting access to personal information to those who need it

We cannot guarantee absolute security of information transmitted over the internet.

7. DATA RETENTION

We retain your personal information for as long as necessary for the purposes for which it was collected, or as required by applicable legal, insurance, tax, accounting or record-keeping obligations.

Our current retention periods include:

• Signed Participant Waivers (participants and spectators): generally a minimum of 7 years from the session date
• Signed Participant Waivers for minors (participants and spectators): until the person turns 25, or 7 years from the session date, whichever is longer
• Other visitor records: generally 12 months from the date of the visit
• Booking records: generally 7 years for tax, accounting and business record-keeping purposes
• Payment records: generally 7 years where required for tax and accounting purposes
• Survey responses: generally 12 months, or until no longer needed for product and pricing decisions
• Marketing opt-in records: retained while you remain subscribed. If you unsubscribe, we may retain limited information necessary to record your preference not to receive marketing communications
• Website analytics and advertising data: retained in accordance with the settings and retention periods of the relevant platform, including Google and Meta

When personal information is no longer required, we will securely destroy, delete or de-identify it.

8. YOUR RIGHTS

You have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate, incomplete or outdated information
• Withdraw consent for marketing communications at any time by clicking "unsubscribe" in any email or contacting us directly
• Opt out of advertising cookies and tracking, as described in Section 9
• Make a complaint about how we have handled your personal information

9. COOKIES & WEBSITE ANALYTICS

Our website uses cookies and similar technologies. Cookies are small text files stored on your device. When you first visit our website, a cookie banner lets you accept or reject non-essential cookies, including analytics and advertising cookies.

Google Analytics

We use Google Analytics to understand how visitors use our website, such as which pages are visited and for how long. Google Analytics collects information such as your IP address, browser and device type, and the pages you view. Google may process this information in the United States. You can learn how Google uses this information at https://policies.google.com/technologies/partner-sites and opt out using the Google Analytics opt-out browser add-on at https://tools.google.com/dlpage/gaoptout.

Meta Pixel

We use the Meta Pixel, a small piece of code provided by Meta Platforms, Inc., the owner of Facebook and Instagram. The Meta Pixel places or reads cookies and records actions you take on our website.

What the Meta Pixel collects:

• The pages you view and actions you take on our website, such as clicking through to make a booking
• Your IP address, browser and device information, and cookie identifiers
• The date and time of your visit and the referring website
• If you enter details such as your email address or phone number on our website, a hashed (scrambled) version of that information may be sent to Meta so it can be matched to a Meta account

Why we use it:

• To measure how well our Facebook and Instagram ads work, such as whether people who saw an ad later visited our website or made a booking
• To show our ads to people who have visited our website (sometimes called retargeting or remarketing)
• To show our ads to people on Facebook and Instagram who may have similar interests to our visitors

Meta receives this information directly from your browser and may combine it with information it holds about you if you have a Facebook or Instagram account. Meta uses it in accordance with its own privacy policy, available at https://www.facebook.com/privacy/policy, and may process it in the United States and other countries. We do not receive information that personally identifies you from Meta. We receive aggregated reports about ad performance and audiences.

Your choices

• Use the cookie banner on our website to reject non-essential cookies. Analytics and advertising cookies, including the Meta Pixel, only operate if you accept them
• Change your cookie choice at any time by clearing your browser cookies and revisiting our website, or by adjusting your browser settings to block or delete cookies
• If you have a Facebook or Instagram account, manage how Meta uses information from websites in your Accounts Centre under "Your activity off Meta technologies" and "Ad preferences"
• Opt out of interest-based advertising from participating companies at https://www.youronlinechoices.com.au

Blocking cookies may affect some website functionality.

Apart from the information described above, we do not use cookies to collect personally identifiable information.

10. PHOTOGRAPHY & SOCIAL MEDIA

Zadi Studios may photograph or film sessions for promotional purposes, including for our website, Instagram and other social channels.

Your photography and filming preferences are recorded in your Participant Waiver. If you do not wish to be photographed or filmed, note this in your waiver and let your instructor know when you arrive.

If you have previously consented and change your mind, contact us and we will remove identifiable images as promptly as practicable where reasonably possible.

A refusal to consent to photography or filming will not affect a person's ability to participate.

Please do not photograph or film other participants without their express consent.

11. CHILDREN'S PRIVACY

Anyone under 18 who participates in or attends a session must have a parent or guardian complete and sign the Participant Waiver on their behalf, as set out in our Terms & Conditions.

We collect personal information about minors only as necessary for their safe participation or attendance.

Minors' information is handled with additional care and is never used for marketing purposes.

No images of children will be published without separate explicit written consent from a parent or guardian.

12. SPECTATORS, SUPERVISORS AND VISITORS

If you accompany a participant as a spectator, supervisor or visitor, we will collect limited information such as your name and contact details.

Spectators are required to complete the Participant Waiver before entering the studio. This information is used to record that they have acknowledged the risks associated with the studio environment and agreed to comply with applicable safety requirements. 

Spectator Participant Waivers are retained on the same basis as participant waivers: generally a minimum of 7 years from the session date, or for minors until they turn 25 or 7 years from the session date, whichever is longer. Other visitor records are generally retained for 12 months from the date of the visit.

Spectator and visitor information is not used for marketing unless you separately opt in to receive marketing communications.

13. DATA BREACH NOTIFICATION

While Zadi Studios is not currently required to comply with the Notifiable Data Breaches (NDB) scheme under the Privacy Act due to our size, we have adopted the principles of the scheme as our own practice given the sensitivity of the health information we collect.

If we experience a data breach that is likely to result in serious harm to you, we will take appropriate steps to contain and investigate the breach and, where appropriate, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with applicable requirements and our adopted data breach response procedures.

14. AUTOMATED DECISION-MAKING

Zadi Studios does not use automated decision-making or artificial intelligence to make decisions about you, your bookings or your eligibility to participate in our sessions.

All decisions about bookings, safety and participation are made by a person.

15. COMPLAINTS

If you believe we have mishandled your personal information, please contact us first at contact@zadistudios.com.

We aim to respond to privacy enquiries and complaints within a reasonable period.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

16. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements, including any future changes to the small business exemption described above.

The current version will always be published on our website.

We will notify you of material changes by email if we hold your email address.
